TERMS AND CONDITIONS OF SALE (T&Cs)

PREAMBLE

These Terms and Conditions of Sale (hereinafter the “Terms”) are entered into between:

Azure & Gaia, a sole proprietorship (micro-enterprise), registered with the Trade Register under SIRET number 853 833 416 00037, represented by Ms Zoé Rémon as manager,
hereinafter referred to as the “Seller” or “Azure & Gaia”,

and

any natural or legal person purchasing products on the website www.azureetgaia.fr,
hereinafter referred to as the “Customer”.

1. PURPOSE AND ACCEPTANCE OF THE TERMS

These Terms define the rights and obligations of the parties in relation to the online sale of products offered on the website www.azureetgaia.fr (the “Website”).

Any order placed on the Website implies full and unconditional acceptance of these Terms by the Customer.

The Seller reserves the right to modify these Terms at any time. The applicable Terms are those in force on the date of the order.

2. PRODUCTS

The products offered for sale are those displayed on the Website, subject to availability or production capacity.

As products are handmade, slight variations in color, shape, or finish may occur and do not constitute a defect.

Product images are non-contractual.

3. PRICES

Prices are indicated in euros (€).
The Seller is not subject to VAT (article 293 B of the French General Tax Code).

Delivery costs are shown prior to order confirmation.

The Seller reserves the right to change prices at any time, without affecting confirmed orders.

4. ORDERS

An order is considered final once:

  • the cart is validated,
  • the Terms are accepted,
  • and full payment is completed.

The Seller reserves the right to refuse any order in case of existing disputes, suspected fraud, or abnormal order behavior.

5. PAYMENT

Payment is due immediately at the time of order.

Payments are securely processed via Shopify Payments and PayPal.

The Customer guarantees that they are the legal holder of the payment method used.

In case of payment refusal, the order is automatically cancelled.

6. DELIVERY

Delivery Areas

France, Europe, and international destinations.

Indicative Delivery Times

  • France: 2–3 business days after shipment
  • Europe: 3–7 business days
  • International: 7–15 business days

A production or preparation time may apply before shipment.

Delivery Address

Products are delivered to the address provided by the Customer. The Customer is responsible for ensuring the accuracy of the information provided.

Risk Transfer

Risk transfers to the Customer once the parcel is handed over to the carrier.

7. RIGHT OF WITHDRAWAL (LEGAL – 14 DAYS)

In accordance with Articles L221-18 and following of the French Consumer Code, the Customer has a 14-day withdrawal period from the date of receipt of the order, without providing any reason.

Products must be returned:

  • in their original condition,
  • unused (except for minimal handling necessary for inspection),
  • complete and properly packaged.

Return shipping costs are borne by the Customer.

8. RETURNS AND REFUNDS

After receipt and inspection of the returned product, a refund will be issued to the original payment method.

A partial refund may be applied in case of:

  • excessive use of the product,
  • damage,
  • missing items,
  • non-compliance with return conditions.

Custom-made or personalized products (if applicable) are not eligible for withdrawal.

9. LEGAL WARRANTIES

The Customer benefits from:

  • the legal guarantee of conformity (Articles L217-3 and following of the French Consumer Code),
  • the warranty against hidden defects (Articles 1641 and following of the French Civil Code).

The Customer has a period of 2 years from delivery to exercise these rights.

10. LIABILITY

The Seller shall not be held liable for:

  • improper use of the product,
  • normal wear and tear,
  • minor variations due to handmade production,
  • force majeure events.

11. INTELLECTUAL PROPERTY

All content on the Website (texts, images, designs, products, logo) remains the exclusive property of Azure & Gaia.

Any reproduction is strictly prohibited without prior authorization.

12. PERSONAL DATA (GDPR)

Personal data is collected solely for:

  • order processing,
  • delivery,
  • invoicing,
  • customer service.

Data is processed in accordance with GDPR regulations.

The Customer has the right to:

  • access,
  • rectify,
  • delete,
  • and object to their data.

13. CUSTOMER SERVICE AND MEDIATION

In case of dispute, the Customer must first contact:

In accordance with French consumer law, the Customer may use a free consumer mediation service if no amicable solution is reached.

14. FORCE MAJEURE

The Seller shall not be held responsible for failure to perform due to events beyond its control (strikes, transport disruptions, natural disasters, etc.).

15. APPLICABLE LAW

These Terms are governed by French law.

If any clause is found to be invalid, the remaining provisions shall remain fully applicable.
